HILLSBOROUGH JUDGE DENIES DEFENDANT’S NEW TRIAL MOTION IN FRANK D. BUTLER, PA $4.4 MILLION VERDICT IN FAVOR OF CLIENT

Butler, PA (www.FightingForFamilies.com) we previously reported that in mid-April 2025 in Hillsborough County, Florida we the attorneys at www.FightingForFamilies.com obtained a $4.4 million jury verdict in favor of our client. The result was from a two-week trial for our client and many hours of preparation and fighting for that deserving client. We can now also report at www.FightingForFamilies.com (Frank D. Butler, PA) that the trial judge has denied the Defendant’s Motion For New Trial and denied the Defendant’s Motion for Directed verdict by Order entered on August 23 2025. This is an important step toward collecting the verdict for our client in that the Defendant, an insurance company, had asked the judge to toss out the jury’s $4.4 million award—which the trial judge declined to do.
Other motions by www.FightingForFamilies.com for our client remain to be heard by the judge to add on attorney’s fees and costs in the case in favor of the injured claimant. This will include more than $200,000.00 www.FightingForFamilies.com spent in costs in favor of our deserving client. In this case the Defendant failed to accept a Florida Statute §768.79 Proposal For Settlement during the course of the case, and then the Plaintiff’s jury verdict exceeded the offered amount by far. Under Florida law when a party to an injury suit fails to accept a Proposal For Settlement (a/k/a PFS) within the 30-day time to do so, the Court can award attorney’s fees to the claimant in addition to the award by the jury. Such an award is beneficial to the client because it helps collect costs and attorney’s fees expended on the case.
